Principles of data processing at the Neue Herbold GmbH

Of the General Data Protection Regulation (DSGVO), we would like to present our information on data protection below:

Which data from you are processed by us? And for what purposes?

If we have received data from you, we will only process it for the purposes for which we received or collected it. You have sent us an e-mail and we process the data contained therein (name, e-mail address, content) for the purpose of answering your request.

We also consider this request as consent to such processing (Article 6 (1) (a) GDPR). If you no longer wish to receive an answer from us, you can revoke this consent at any time. In this case, we will no longer contact you.

In case of a cancellation, your data will be deleted insofar as we are not legally obliged to keep it. You can request these obligations from us at any time for your individual case.

Data processing for other purposes can only be considered if the legal requirements to that extent required under Article 6 (4) GDPR are met. In the case, of course, we will observe any information requirements according to Art. 13 para. 3 DSGVO and Art. 14 para. 4 DSGVO.

To which recipients will the data be passed on?

A transfer of your personal data to third parties will only take place if this is necessary for the execution of the contract with you. This refers to companies that provide services for us, e.g. our tax adviser or lawyer. These service providers will use your data only on our behalf and never for their own purposes.

Where is the data processed?

Your personal data will be processed by us exclusively in data centers of the Federal Republic of Germany.

Communication via online-based audio and video conferences (conference tools)

We use online conference tools for communication with our customers. The individual tools we use are listed below. If you communicate with us via video or audio conference via the Internet, your personal data will be recorded and processed by us and the provider of the respective conference tool. The conference tools collect all data that you provide / use to use the tools (email address and / or your telephone number). The conference tools also process the duration of the conference, start and end (time) of participation in the conference, number of participants and other “context information” in connection with the communication process (metadata).

In addition, the tool provider processes all technical data that are required to process online communication. This includes in particular IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker as well as the type of connection. If content is exchanged, uploaded or made available in any other way within the tool, it is also stored on the servers of the tool provider. Such content includes in particular cloud recordings, chat / instant messages, voicemails, uploaded photos and videos, files, whiteboards and other information that is shared while using the service.

Please note that we do not have full influence on the data processing operations of the tools used. Our options are largely based on the company policy of the respective provider. Further information on data processing by the conference tools can be found in the data protection declarations of the tools used, which we have listed under this text. Purpose and legal basis The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 Para. 1 S. 1 lit. b GDPR).

Furthermore, the use of the tools serves to generally simplify and accelerate communication with us or our company (legitimate interest within the meaning of Art. 6 Para. 1 lit. f GDPR). If consent has been requested, the relevant tools are used on the basis of this consent; the consent can be revoked at any time with effect for the future. Storage period The data collected directly by us via the video and conference tools will be deleted from our systems as soon as you ask us to delete them, revoke your consent to storage or the purpose for data storage no longer applies.

Saved cookies remain on your device until you delete them. Mandatory statutory retention periods remain unaffected. We have no influence on the storage period of your data, which is stored by the operators of the conference tools for their own purposes. For details, please contact the operators of the conference tools directly. Conference tools used We use the following conference tools: Microsoft Teams We use Microsoft Teams. The provider is Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA.

Conclusion of an order processing contract We have concluded an order processing contract with the provider of Microsoft Teams and fully implement the strict requirements of the German data protection authorities when using Microsoft Teams. zoom We use zoom. The provider of this service is Zoom Communications Inc., San Jose, 55 Almaden Boulevard, 6th Floor, San Jose, CA 95113, USA.

Conclusion of an order processing contract We have concluded an order processing contract with the provider of Zoom and fully implement the strict requirements of the German data protection authorities when using Zoom.

Your rights as “concerned”

You have the right to information about the personal data we process about you.

In the case of a request for information that is not made in writing, we ask for your understanding that we may then ask for proof from you proving that you are the person for whom you are claiming to be.

You also have the right to correct or delete or limit processing to the extent that you are legally entitled to do so.

Furthermore, you have the right to object to the processing within the scope of the legal requirements. The same applies to a right to data portability.

In particular, you have the right to object to the processing of your data in connection with direct advertising, if this is done on the basis of a balance of interests, in accordance with Art. 21 para. 1 and 2 DSGVO.
